;Software License Agreement for SMW+ 1.6.0 Community Edition ;Between: :You ;and :ontoprise :Address: :ontoprise GmbH :An der RaumFabrik 29 :76227 Karlsruhe 1 Subject matter of the agreement 1.1 You "Licensee" hereby acquire the software suite "SMW+ Community Edition" from ontoprise (the Software) together with the accompanying application documentation (the Application Documentation), in english language (altogether the Subject Of Agreement), according to the terms of this agreement (the Agreement). 1.2 The Software consists of the "halo Extension", "Wiki Administration Tool", "Smwplus", "Enhanced retrieval Extension", "Application Programming extension" and "WYSIWYG extension" software distributed together with certain open source software separate from ontoprise's own software products and licensed under different license terms. The relevant software and license terms are listed in Annex 1 and Annex 2 which is an integral part of this Agreement. 2 License and terms 2.1 We grant Licensee a non-exclusive, royalty free and non-transferable license to use the Software and to use the Application Documentations for any purpose other than its incorporation in a commercial product or its commercial distribution or redistribution provided that Licensee does not utilize the software in a manner which is disparaging to ontoprise. The Licensee may not (1) sell, rent, lease or sublicense rights in this software, (2) remove or alter any trademark, logo, copyright or other proprietary notices, legends, symbols or labels, (3) Licensee is not allowed without explicit approval of licensor to perform any performance- or functional measurements against licensed SW and publish those. This software is provided " AS IS " , without a warranty of any kind.
